The obligation to preserve the confidentiality of information in the negotiation phase of contracts in general and concluded through electronic means has a vital role to play in achieving the security of this fateful phase, the implementation of the obligation to inform imposed by the principle of good faith on the negotiation may lead the negotiating parties to arrive at information that they would not have learned the negotiation, the French legislator intervened after amending the civil code in 2016 to codify this obligation with a penality, which the Algerian legislator did not agree with, the aim of our research is to demonstrate the important of this commitment in building the contract and enhancing the security of the negotiation.
