The article deals the means exception of unconstitutionality of laws in the Algeria and then Tunisian experiences, by comparing the Convergences and Differences between them in the conditions and how use that mechanism, as one of the mechanisms of subsequent control over the constitutionality of laws newly adopted in both countries, Through which individuals can contest the law on which the judiciary of their dispute depends before judiciary, and the extent to which the desired goals of the work of this mechanism are achieved, which is to protect the rights and freedoms of individuals and to involve them in purifying the legal system from texts that violate the constitution in the two countries.
