Abstract EN
Among the results produced by the principle of the authority of the will is the lack of a contractual balance between the contracting parties in terms of right and obligation the article 106 from civil law state that: “the contract is the law of the contracting parties and it may not be revoked or amended except by agreement of the two parties or for the reasons approved by the law the freedom of contract is a principle approved by international legislations and placed in its national laws where the problem with this principle is that it does not protect the weaker party which is the Bouyer in other hand the seller is required to give information related to the good so that the buyer can provide information in order to protect the consumer will now Algerian legislator promulgation laws such as law n 18-05 relating electronic commerce and law n 09-03 relating protection of consumer and law n 04-02 relating the general rules applicable act of commerce in order to give effective protection to consumer in electronic contract beside this civil liability and criminal liability as means of protection.
