The scientific discoveries and inventions constitute a particular importance for the technical progress of societies, as they are considered a fixed indicator of the economic prosperity.

patents occupy a prominent position in the economic life, due to the effects of their exploitation.

because patents are money with an economic value, which makes them fall within the positive aspect of the inventor’s financial disclosures, and thus, they can be subject to several administrative behaviors from his side.

the inventor usually has recourse to waiving his patent for others, if he is not aware of the nature of market and business, so, he prefers to conclude such contract, which constitute an important economic tool, for the exploitation of patents.

given the importance of this contract, from the legal and economic sides, this study came as an attempt of capturing its legal aspects, to identify its specificity.
