The jurisprudential and legal vision of the punishment of extremists and terrorists in the Islamic regime

Abstract EN

This research aims to clarify the Islamic jurisprudential and legal vision of punishment, especially for extremists and terrorists, from a legal perspective to refute the accusations leveled against Islam and its regime's institutions and link them to the actions of some misguided groups of the nation, by clarifying the mechanism of governance in Islam and consolidating the concepts, elements and pillars of regime in Islam.

The research tries to show the wise legislator's method of disciplining and reforming people before punishing them, and using the method of deterrence and punishment against injustice in proportion to the size of the offense.

The legislator enjoined punishment on the criminal extremists to support of the oppressed.

The punishment of Haraba (terrorism) is one of Hudud (punishments that under Islamic shariah) stipulated in the Holy Qur’an.

This research is divided into an introduction and three chapters.

The first chapter discusses the mechanism of the ruling system in Islam.

The second chapter touches on the jurisprudential and legal vision of punishment from an Islamic perspective.

The third deals with the penalties resulting from extremism and terrorism.

The research ends with a conclusion, findings and recommendations.
