Arabic Abstract

تناولت هذه الدراسة واقع حقوق الإنسان في الدولة الزنكية خلال فترة حكمهم الممتدة من (521ه-1127م-660ه-1261م)، وتم تقسيم الدراسة إلى فصل تمهيدي وخمسة فصول أخرى، تحدث الفصل التمهيدي عن تعريف حقوق الإنسان وأهميتها، وتناول أوضاع المشرق الإسلامي قبل مجيء الزنكيين، وذكر أبرز الشخصيات الزنكية التي حكمت البلاد الإسلامية.

وركز الفصل الأول: على الحقوق السياسية والعسكرية في الدولة الزنكية ومنها: الحق في الشورى والمشاركة السياسية وحقوق المجاهدين في تجهيزهم وإعدادهم للقتال، وحمايتهم ورعايتهم ورعاية ذويهم.

وأما الفصل الثاني: فتناول الحقوق الثقافية الفكرية في الدولة الزنكية، وخاصة الحق في التعليم والصحة.

وتناول الفصل الثالث: الحقوق الاجتماعية، وركز على الحق في العدل والمساواة والإنفاق على التكافل والضمان الاجتماعي، وحقوق المرأة، وحقوق الخدم والموظفين وعامة الناس.

وأما الفصل الرابع: فتحدث عن الحقوق الدينية في الدولة الزنكية، وخاصة الحق في ممارسة الشعائر الدينية، وإنشاء دور العبادة الدينية، وحق تربية الأجيال المسلمة على المذهب السني، وحقوق أهل الذمة.

أما الفصل الخامس: فتناول الحقوق الاقتصادية في الدولة، وركز على الحق في العدالة الضريبية، وحقوق الفلاحيين، والحق في التجارة.

وأنهت الباحثة الدراسة بخاتمة تحتوي على أهم النتائج والتوصيات، وثبت بقائمة المصادر والمراجع التي اعتمد عليها.

English Abstract

This study addressed the reality of human rights in the Zengid State during their rule from (521AH/1127AD – 660AH/1261AD).

The study was divided into an introductory chapter and five chapters.

The introductory chapter talked about the definition of human rights and their importance, and it dealt with the conditions of the Islamic East before the advent of Zengids.

Also, it mentioned the most prominent Zengi figures who ruled the Islamic countries.

The first chapter focused on political and military rights in Zengid State including the right to consultation and political participation, the rights of fighters in preparing them for fighting, protecting and caring for them and for their families.The second chapter dealt with intellectual and cultural rights in the Zengid State, especially the right to education and health.

The third chapter looked into the social rights and focused on the right to justice and equality, spending on social solidarity and security, women's rights, and the rights of servants, employees and the general public .

The fourth chapter examined the religious rights in Zengid State, especially the right to practice religious rites, the establishment of religious places of worship, the right to educate Muslim generations on the Sunni sect, and the rights of the ‘Dhimmis’ [non-Muslim communities under Muslim rule and protection].

Chapter five dealt with the economic rights in the State, and it concentrated on the right to tax justice, farmers’ rights, and the right to trade.

The researcher ended the study with a conclusion containing the most important results and recommendations, and included a list of the sources and references that were used in the study.
