تقدم هذه الأطروحة تحليلا لغويا للصعوبات التي يمكن أن يواجهها المترجمون الفلسطينيون المحلفون عند ترجمة وثائق المحكمة الشرعية إلى اللغة الإنجليزية، حيث تقوم بتحليل أربع ترجمات مختلفة قدمها أربعة مترجمين محلفين الخمسين عبارة وخمسة وثلاثين جملة تم اختيارها من وثائق المحاكم الشرعية لمختلف المحاكم الشرعية في قطاع غزة بالتشاور مع متخصصين في القانون.

تم تحليل الترجمات بناء على ترجمات مقترحة من قبل المشرف المتخصص في الترجمة.

علاوة على ذلك، تم اعتماد تقنيات ترجمة فيناي ودار بالنت لتصنيف استراتيجيات الترجمة التي اعتمدها المترجمون الأربعة تظهر نتائج التحليل أن المترجمين الأربعة واجهوا بعض المشاكل التي يمكن أن تعزى إلى عدم إلمامهم ببعض الفروقات بين مصطلحات المحكمة الشرعية والمصطلحات الإنجليزية، وعدم الإلمام بالمعاني المحددة لبعض مصطلحات المحكمة الشرعية، بالإضافة للفجوات المعجمية والنحوية.

كما تظهر النتائج أن إساءة استخدام بعض استراتيجيات الترجمة قد يؤدي إلى ترجمات غير دقيقة كما هو الحال مع العديد من المصطلحات المترجمة حرفيا.

تسلط توصيات هذه الدراسة الضوء على أهمية إلمام المترجمين بوثائق المحاكم الشرعية من حيث المعاني والهياكل المحددة.

بالإضافة إلى ذلك، يطلب من المترجمين أيضا استخدام استراتيجيات الترجمة المناسبة والمشاركة في التجمعات الأكاديمية التي تناقش القضايا المتعلقة بالترجمة القانونية بين الإنجليزية والعربية.

English Abstract

This thesis provides a linguistic analysis of the difficulties Palestinian sworn translators face when translating sharia court documents into English.

It analyzes four different translations by four sworn translators for fifty phrases terms and thirty-five sensational sentence extracts were selected from sharia court documents of different sharia courts in Gaza Strip by consultation with specialists in law.

The translations were analyzed based on suggested translations by the supervisor, who is a specialist in translation.

Further, Vinay and Darblent’s translation procedures were adopted to classify the translation strategies adopted by the four translators.

The results of the analysis show that the four translators faced some problems which could be attributed to unfamiliarity with certain differences between the sharia-court terms and the English terms, unfamiliarity with the specific meanings of some sharia-court terms, lexical gaps and syntactic problems at a minor extent.

The results also show that misusing some translation strategies can result in inaccurate translations as in the case with many literally translated terms.

This study recommendations highlight the importance of translators’ familiarity with sharia-court documents in terms of specific meanings and structures.

In addition, translators are also requested to use appropriate translation strategies and participate in academic gatherings which discuss issues related to legal translation between English and Arabic.
