يظهر اهتمام الأصوليين بتفسير النصوص الشرعية من خلال اجتهادهم في وضع ضوابط تحكم هذا التفسير، حيث اعتنوا باستخلاص الأحكام الموجهة إلى المكلفين بــها، فكانت القرينة الأصولية إحدى هذه الضوابط، وانطلاقا مما سبق نتساءل: ما الدور الذي أدته القرائن في ترجيح الخطاب الشرعي؟ وللإجابة عن هذا السؤال اتبعنا المنهج الوصفي بآلية التحليل، وقد توصلنا في بحثنا هذا إلى نتائج منها: للقرينة دور في الترجيح بين دلالات الألفاظ الشرعية.
Abstract EN
The interest of fundamentalists about the interpretation of legal texts appears in the diligence to implement controls to lead this interpretation.
they took care of extraction of provisions for those charged of them.
therefore, the fundamental indication is one of those controls.
what is the role of fundamental indication to make the preference of legal speech? to answer, I follow the descriptive analytical method.
the result of the research is: the indication has a great role to prefer the signification of the legal terminology.
