This study examines the crime of hate speech, which was recently organized by the Algerian legislator under law No.

20-05 related to the prevention and combating of discrimination and hate speech.

the legal element, then the material element, which includes talking about what is meant by hate speech, its forms and its legal nature, and finally the moral element, beginning with the general and then the specific criminal intent, as well as the provisions related to the criminal penalty, which include the original penalties prescribed for the perpetrator of this crime, whether a natural or legal person, and also include complementary penalties, in addition to some other penal provisions, related to the attempt and excuses exempting from punishment or mitigating or aggravating circumstances, and the provisions of the criminal agreement.
