On November 11, 2019, the state of Gambia filed a complaint against the state of Myanmar before the international court of justice, in order to hold it responsible for its violation of its obligations arising from the convention on the prevention and punishment of the crime of genocide concluded in 1948, because of its grave violations of human rights committed against the Rohingya Muslim minority during the years 2016 and 2017, to which Myanmar responded with a set of preliminary objections in order to obstruct the issue of competence of the court to adjudicate this complaint.

after studying these objections, this court announced its position on them in accordance with its judgment issued on July 22, 2022.

this article aims to outline these preliminary objections and the basis of the court's legal answers to them, especially since the victims of the Rohingya minority do not have any legal association with the state of the Gambia.
