Abstract EN

In this study, we examined abortion between criminalization and permission as criminal protection for the health of pregnant mothers in Algerian legislation, through which the legal safeguards enshrined legislation protect the health of pregnant mothers by criminalizing abortion unnecessarily and punishing the perpetrator even if the mother herself regardless of the outcome.

if the pregnancy itself constitutes a threat to the mother's life and health, the legislator intervened and permitted abortion if there were reasons for it, only in cases of necessity, in contrast, the new health law expands its justification so that any threat to the psychological and mental balance of the mother is considered sufficient justification for performing an abortion without giving a precise and clear criterion determining the risk.

in order to ensure the application of these regulations, the Algerian legislature has confirmed the procedure in public hospital institutions.
