The concession contract, which can be converted into a waiver in order to complete commercial real estate promotion projects, is established by the Algerian legislator.

as mechanism to support the real estate developers with a land base of national private property in order to complete his housing project, this contributes to the elimination of the problem of housing in Algeria.

and the concession contract like all other contracts has an effect on the parties of the contract, so through this study we aim first to define the concept of this contract and the procedures for its conclusion and then, after we determine its nature, we know the set of effects that it has on the parties of the contract, the concession contract really entails a set of rights for both parties of the contract against the second party.

the state party shall avail itself of these rights on the basis of the concession contract; in return, each of the parties to the contract has a set of legal obligations that it has to perform in the other party's interest in the contract.
