Abstract EN

It is well known and established in the Algerian legislation that the preliminary investigation is entrusted to the investigating judge.

the latter is the empowered entity by the legislator in order to uncover the crime and apprehend its perpetrators.

in addition to that, she has sufficient powers to initiate any investigation procedure he deems necessary imncluding interrogation.

nonetheless, alongside these powers, the investigative judge is restricted on the condition of guaranteeing the rights of the defense.

furthermore, the legality of this procedure has become conditional upon respecting all guarantees and protection of the basic rights of the accused, and at the same time guarantees his legal and proper interrogation.
