يرتبط مفهوم المواطنة ارتباطا وثيقا بالحقوق والحريات وكيفية الممارسة لها و معرفة المواطن لمسؤولياته و واجباته، حيث يتطلب نجاح المواطنة واستقرارها تحقيق التوازن بين ضرورة تهيئة الظروف لتمكين كل فرد من التمتع بحقوقه، و بين واجبات الفرد إزاء الأفراد الآخرين وإزاء الجماعة التي ينتمي إليها، و ذلك من حيث مسؤوليته في السعي إلى تعزيز و مراعاة الحقوق المعترف بها في المنظومة التشريعية للدولة، فيجب عند مباشرة المواطن لحقوقه و حرياته مراعاة حقوق وحريات الآخرين، فالحقوق و الحريات ليست مطلقة، و إنما يتعين وضع ضوابط تنظم ممارسة الحق، لمنع نشوء صراع بين الحقوق المتقابلة والذي قد يؤدي إلى حدوث فوضى اجتماعية.
و تتناول هذه الدراسة تنظيم العلاقة بين المواطن و الدولة من خلال الحقوق والواجبات و المسؤوليات المرتبطة بكل منهما في دستور جمهورية العراق لسنة 2005.
English Abstract
The concept of citizenship is closely related to rights and freedoms and how to exercise them and the citizen's knowledge of his responsibilities and duties.
The success and stability of citizenship requires achieving a balance between the need to create conditions to enable each individual to enjoy his rights, and the individual's duties towards other individuals and towards the group to which he belongs through his responsibility of seeking to promote and take into account the rights recognized in the legislative system of the state.
When citizens exercise their rights and freedoms, the rights and freedoms of others must be taken into account.
Rights and freedoms are not absolute, but rather, controls must be established that regulate the exercise of the right, to prevent the emergence of a conflict between opposite rights that may lead to social chaos.
This study deals with the regulation of the relationship between the citizen and the state through the rights, duties and responsibilities associated with each of them in the Constitution of the Republic of Iraq for the year 2005.
