the recognition and establishment of this right, aiming to promote sustainable development, emerged from the realization of the imperative to strike a balance between safeguarding the environment and upholding human rights as an interconnected whole.

nevertheless, similar to other rights granted to individuals, the right to a clean environment has been affirmed in numerous regular and constitutional legal documents, both at the national and international levels.

however, it has not been immune to discrimination and infringement.

this is primarily due to the lack of effective legal mechanisms to enforce environmental regulations and a general lack of legal awareness among individuals regarding the significance of enjoying a healthy environment.

additionally, legal authorities have been slow in prioritizing and establishing this right.
