Abstract AR
تناولت هذه الدراسة موضوعا من موضوعات علم أصول الفقه و هو : العلاقة بين الاستحسان و الرخص الشرعية.
و تعرضت الدراسة لتعريف الاستحسان و الرخص الشرعية في اللغة و الاصطلاح، وبيان أنواع كل منهما، و قام الباحث ببيان أوجه الاتفاق و الاختلاف بين الاستحسان والرخص الشرعية، وبينت الدراسة أن أبرز وجوه الاتفاق بينهما أن كلاهما استثناء من حكم كلي إلى حكم جزئي أخر، وأن أبرز أوجه الاختلاف هو : أن الاستحسان يكون في باب الأدلة المختلف فيها، و أن الرخص الشرعية حكم من الأحكام الشرعية.
و قد ختمت الدراسة بمسائل تطبيقية في العبادات و المعاملات و الأحوال الشخصية، لتدلل على طبيعة العلاقة بين الاستحسان والرخص الشرعية.
Abstract EN
This study dealt with one of the topics of the science of jurisprudence, which is : the relationship between approval and legal licenses.
The study presented the definition of approval and legal licenses in language and terminology, and a statement of the types of each.
The evidence differs, and that the legal licenses are one of the legal rulings, The study concluded with practical issues in worship, transactions and personal status, to .demonstrate the nature of the relationship between approval and legal licenses .
