Abstract EN

The current study examines the rules of giving preference and its applications in endowments in terms of the effectiveness of their mechanism in some applied problems.

The study consists of a preface, two main chapters and a conclusion.

The preface addresses the importance of the endowment and the importance of Fiqhi rules, including the rules of giving preference to endowments.

The first chapter addresses the definitions of study terms (i.e., the rules of giving preference and endowments).

The second chapter addresses the fourteenth rules of giving preference (e.g.

"The public interest is prioritized over the private interest" and "In case of two conditions contradict, the latter is to be adopted") by identifying the meaning of each rule as outlined, in addition to providing an endowment ¦ application along with the statement of giving preference.

The study revealed that the rules of giving preference affect the waqf provisions since they take into account the best endowment conditions.

The study recommends further research to compare the ways of addressing endowment problems between the rules of Islamic Fiqh and the rules of law and to consider their compatibility and difference in addressing such problems.
