The penal endowment of civil litigation is a procedural penalty that can be resorted to when the litigants or court employees fail to implement what the court may order.

Where the Egyptian legislator granted the judge the authority to gradually impose procedural sanctions, including Penal Endowment for Civil Litigation.

While the Palestinian legislator did not address such a penalty, the researcher worked on studying the penal endowment for litigation and looking at the possibility of implementing it in Palestinian legislation.

The aim of the research was to find a means that can be resorted to in order to compel litigants and employees to implement what the court orders, which eliminates the phenomenon of slow litigation and speedy settlement of disputes.

This resulted in the adoption of the idea of a penal endowment of litigation in the Palestinian legislation to limit the imposition of the penalty for nullity and resort to gradual imposition of procedural penalties.
