يجب الاعتراف بالفصل بين نظامي التجريم والانضباط أحدهما عن الآخر كقاعدة عامة مع التسليم بتقييد نظام الانضباط ببعض ما تقرر في نطاق القواعد العامة للعقاب، وترتب على هذا الاستقلال باعتراف مستقل للجريمة الانضباطية عن الجريمة الجنائية، وإن كان هناك ترابط بينهما مع القبول بأن الكثير من مبادئ القانون الجنائي تجد مجالا لها في التطبيق في المجال الانضباطي، کأسباب الإباحة؛ لذا اتحد العقاب الجنائي مع الانضباطي في غاية واحدة هي حماية النظام الجنائي.
Abstract EN
Disciplinary procedures may overlap with criminal procedures.
However, the separation must be recognized between the two systems as criminal charges are different from disciplinary offences.
Despite the fact that the general principles of criminal law are applicable to disciplinary sanctions such as the permissibility principle, the criminal offences interact with disciplinary when they aim to protect the criminal justice system.
