The issue of humanitarian intervention is one of the issues that are closely linked to the cause of human rights and the protection of human rights. Through concerted international efforts to secure these rights if they are subjected to any violation and by any party and anywhere. The concept of humanitarian intervention has become more apparent after the end of the Cold War and the subsequent revolutions to overthrow totalitarian political systems. Today's human rights philosophy has become a global consensus, supported by international institutions and codified in constitutional texts and international covenants such as the Universal Declaration of Human Rights. Human rights and guarantees for their enjoyment and protection have become a topic of global concern. This interest also represents the dividing line between the traditional concept of sovereignty and the modern concept of it, which is of a magnitude in content. The study aims to identify the concept of humanitarian intervention and the legal basis for this concept and the justification for intervention for humanitarian purposes and to identify the international positions supporting and opposing him.

يعد موضوع التدخل الانساني احد القضايا المعاصرة التي لها ارتباط وثيق بقضية حقوق الانسان وضمان حمايتها، مـن خلال تضافر الجهـود الدوليـة لتأميـن هـذه الحقـوق اذا ما تعرضـت لأي انتهاك، ومن قبل اي جهة وفي أي مكان، لقـد تبلور هـذا المفهـوم (التدخل الانسـاني) بصـورة أكثر وضوحـا بعد انتهاء الحـرب البـاردة ومـا رافـق ذلك مـن ثورات اطاحة بالأنظمة السياسية الشمولية لقـد أصبحت فلسـفة حقوق الانسـان اليوم محل اجمـاع عالمي، نراهـا مدعومة من قبل المؤسسات العالميـة ومدونـة فـي النصوص الدستورية والمواثيق الدولية مثـل الاعلان العالمي لحقوق الانسان، والمعاهدات والاتفاقيـات التـي تـخـص الحقوق المدنيـة والسياسية والاقتصادية .
اذ ان حقوق الانسان والضمانـات التـي تكفـل التمتع بهـا وحمايتها أصبحت تمثل احد الموضوعات ذات الاهتمام سواء أكانت على الصعيد العالمي ام الاقليمي ام الوطني.
إن الاهتمام بحقوق الانسـان اصبح يمثل الحد الفاصل بين المفهوم التقليدي للسيادة المطلقة ومبدأ.
عدم التدخل في الشؤون الداخلية للـدول والذي كان سائدا قبل الحرب العالمي الثانية، وبين المفهوم الحديث للسيادة والذي حجم من صفة الاطلاق في مضمونها .
تهدف هذه الدراسـة الى التعرف على مفهوم التدخل الانساني والأسانيد القانونية لهذا المفهوم وتبريرات التدخل لأغراض انسـانية، كمـا تـهـدف الـى التـعـرف للمواقف المؤيدة والمعارضة للتدخـل الانسـاني ،اثنـاء تناول مفهوم التدخل وإشكالية السيادة، والاعتبارات السياسية التي تكمن واراء هـذا المفهوم اثناء التطبيـق.
كما يتم تناول ابـرز التطورات التي أثرت على موضوع السيادة وبالشكل الذي اعطي الأولوية للجوانب الانسانية على حساب سيادة الدول.
