Arabic Abstract

يهدف هذا البحث إلى التعريف بعقد البيع الإلكتروني، وعرض لدور البيع الإلكتروني في ظل جائحة كورونا؛ من خلال عرض مقتطفات عن التفاوض وإبرام وإثبات العقد إلكترونيا بين البائع والمشتري، وكذلك من خلال الوفاء الإلكتروني بينهما، نظرا للأهمية التي أحتلها عقد البيع الإلكتروني في ظل جائحة كورونا؛ لكونه هو الذي يحد من انتشار فيروس كورونا المستجد من خلال إبرام وإثبات العقد إلكترونيا بين أطرافه، وكذلك الوفاء بالطرق الإلكترونية؛ مما يمنع أو يقلل من تجمع المستهلكين.

ولكون عقود البيع الإلكترونية تبرم عن بعد؛ أي يتم الإيجاب والقبول بين البائع والمشتري ويتم انعقاد العقد بتطابق الإيجاب والقبول بمجلس عقد إلكتروني، وكذلك يتم إثبات عقد البيع إلكترونيا من خلال محرر إلكتروني بالكتابة والتوقيع عليه إلكترونيا، وأيضا يتم الوفاء بين البائع والمشتري إلكترونيا؛ أي يدفع المشتري ثمن المبيع بالوسائل الإلكترونية، وقد يسلم البائع المبيع إلكترونيا.

كل ذلك جعل عقد البيع الإلكتروني له تأثير فعال في ظل جائحة كورونا.

English Abstract

This research aims to introduce the electronic sales contract and present the role of electronic selling in light of the Corona pandemic.

This will be done by presenting excerpts from the negotiation, conclusion and proof of the contract electronically between the seller and the buyer, as well as through electronic fulfillment between them.

Due to the importance of the electronic sales contract in light of the Corona pandemic as it is the one which limits the spread of the new Corona virus by electronically concluding and proving the contract between its parties, as well as fulfilling electronic methods.

This will in turn prevent or reduce the gathering of consumers.

Electronic sales contracts are concluded remotely, i.e.

the offer and acceptance is made between the seller and the buyer, and the contract is concluded by matching the offer and acceptance by an electronic contract board, and the sale contract is confirmed electronically through an electronic document in writing and signed electronically, and also the fulfillment between the seller and the buyer is done electronically; That is, the buyer pays the price of the sold electronically, and the seller may deliver the sold electronically.

All this made the electronic sales contract effective in light of the Corona pandemic.
