يتناول البحث الأسباب التي تسمح باتخاذ التدابير اللازمة لاحتواء وباء ( كوفيد 19) بموجب قواعد حقوق الإنسان.
ويبين إمكانية حدوث تأثير سيئ لتلك التدابير على تمتع الأفراد بحقوقهم وحرياتهم وبخاصة ما ورد منها في العهد الدولي للحقوق المدنية والسياسية.
ويبين البحث مصادر مشروعية الإجراءات التي يمكن أن تتخذها الحكومات لاحتواء هذا الوباء، سواء أكانت تلك المصادر داخلية أم دولية، وسواء أكانت تلك الإجراءات متخذة في الوضع الطبيعي للدولة أم متخذة وفق حالة الضرورة التي يمكن أن يستدعيها انتشار الوباء على نحو واسع.
ويخلص البحث بعد ذلك إلى أنه في الوقت الذي يكون فيه من الضروري فرض القيود على بعض الحقوق والحريات، مؤقتا، للحد من انتشار الوباء، فإن من الضروري أن تكون هذه القيود محدودة وخاضعة للرقابة توخيا لمنع إساءة استعمال السلطة.
English Abstract
The research deals with the reasons that allow taking the necessary measures to contain the (Covid 19) epidemic according to human rights rules.
It also shows the possibility of a negative impact of these measures on the individuals' enjoyment of their rights and freedoms, especially what was mentioned in the International Covenant on Civil and Political Rights.
The research shows the sources of the legitimacy of the measures that governments can take to contain this epidemic, whether those sources are internal or international, and whether these measures are taken in the natural state of the country or taken according to the state of necessity that may require the spread of the epidemic on a large scale.
The research then concludes that while it is necessary to impose restrictions on some rights and freedoms, temporarily, to limit the spread of the epidemic, it is also necessary that these restrictions be limited and controlled in order to prevent abuse of power
