Abstract EN

In our research, we dealt with the study of the jurisprudential reference to the provisions of the endowment in Algerian legislation; where we shed light on the provisions contained in the different Algerian laws that dealt with the topic of endowments.

And that by linking them to their jurisprudential roots with the aim of knowing the doctrines from which the Algerian legislator derived these rulings, as he did not adopt a specific school of jurisprudence on the one hand, and deducing and knowing the reference adopted by the Algerian legislator on the topic of endowments as a whole on the other hand.

We tried through it to answer a problem centered on the impact of taking jurisprudential rulings related to endowments from several doctrines on the consistency of legal texts, and the extent of its impact on the quality and sophistication of the endowment legislative system in Algeria as a whole, relying in our research on both the descriptive and analytical approaches as well as deductive and inductive mainly because these approaches are most appropriate for such studies, and also the historical and comparative methods secondarily, to come out in the end with some results and suggestions that we included at the end of the research.
