أثبتت تجارب عديدة حول العالم قدرة المجالس الشعبية المصغرة التداولية على الإسهام في صنع التوافقات الضرورية بين مختلف الأفرقاء المعنيين بآليات التعديلات الدستورية في هذا الإطار، حاولنا في هذا البحث إلقاء الضوء على مدى قدرة تلك المجالس الشعبية على إضافة مساهمة نوعية ومشروعة في عملية التعديلات الدستورية.
فإلى جانب تعريجنا على الجانب النظري للدستورانية التداولية، والتي بدورها تندرج في إطار أوسع يرتبط بالحقل المعرفي الخاص بالديمقراطية التداولية، انطلقنا من التجربة الأيرلندية الغنية بالأمثلة على تطعيم آلية تعديل الدستور بنفحة "تداولية" قوامها المجالس الشعبية المصغرة.
بالمقابل، انزلقت العديد من الأنظمة التمثيلية الليبرالية حول العالم في شراك حركات شعبوية بغيضة، لجأت إلى تحوير الضوابط المعيارية والأخلاقية للآليات الخاصة بالتعديلات الدستورية بغية بسط سطوتها على كامل مقاليد الحكم.
لذلك، حاولنا في هذا البحث تبيان صوابية الفرضية القائلة بأن الحقل المعرفي الخاص بالديمقراطية التداولية، بما يحتويه من أدوات إجرائية متميزة على رأسها المجالس الشعبية المصغرة، سلاح فعال في محاربة الهجمات الشرسة التي تعصف بالأنظمة التمثيلية الليبرالية، والتي غالبا ما يكون مصدرها تيارات سياسية وحركات أيديولوجية شعبوية.
Abstract EN
Numerous experiences around the world have proven the ability of deliberative minipublics to contribute to the making of consensus among the various political parties concerned with the mechanism of constitutional amendments.
This paper tries to shed light on the ability of deliberative democracy to add a qualitative and legitimate contribution to the constitutional amendment process, mainly based on Ireland's rich experience in establishing deliberative mini-publics.
On the other hand, many liberal representative systems have fallen into the trap of hateful populist movements, which have resorted to modifying the normative and ethical mechanisms of constitutional amendments in order to extend their control over the entire reins of government.
This paper portrays the deliberative mini-publics, a recent innovation in deliberative democracies, as a roadmap for constitutional reforms and a means by which to minimize the furnace of populism.
