The research at hand aims to define judiciary and testimony, and to justify the difference in the Sharia law between them by studying the legal indicants in the four schools of Islamic jurisprudence.

by exploring the controversy around this issue, the researcher's goal is to arrive to a conclusion that helps to formulate the sharia laws regarding the women's status as judges and witnesses in Islam, which entails the permissibility of including or excluding them from the judicial system.
