Abstract EN

This study concerns all the jurisprudential questions narrated by Ya‘qoub ibn Bukhtan from Imam Ahmad in the chapters on sales and transactions, from the sections on sale to the section on lost property (al Luqatah), as Ya‘qoub's narration went missing a long time ago.

This research uses induction to study the jurisprudential narrations – forty in number - that were transmitted by Ya‘qoub from his sheikh, Imam Ahmad, from the various resources where they are mentioned, then they are compared with other narrations from Ahmad by narrators other than Ya‘qoub ibn Bukhtan concerning the same question, in order to show the extent to which they agree or disagree with Ya`qoub's narration.

This is followed by stating the accredited position adopted by the late Hanbalis on the question, using accredited references, besides stating the agreement or disagreement of what they adopted with Ya‘qoub's narration.

The total number of questions covered and discussed by the research amounts to forty questions listed in the chapters on Sales, Usury, Exchange, Forward Buying, Loan, Mortgage, Guarantee, Reconciliation, Partnership, Leasing, Borrowing, Usurpation, Preemption, Reviving Arid Land, AlJa`ala, and Lost Property.
