شهدت العلاقات التعاقدية خلال جائحة كوفيد - 19 اضطرابًا كبيرًا انعكس بشكل سلبي على عدة التزامات تعاقدية، مما دفع الأطراف المتعاقدة إلى الاحتجاج بالقوة القاهرة من أجل طلب الإعفاء من أي مسؤولية تعاقدية على اعتبار أن كوفيد -19 قوة قاهرة أرهقت كاهل المتعاقدين بالتزامات اضافية، حيث يجب أخذ العديد من العوامل في الحسبان والتعامل مع كل حالة على حدة أمر واجب، كما أصبح من ضرورة بمكان تضمين مجموعة من الشروط في عقود الاعمال والتي تقدم حلولا مسبقة لمثل هذه الحالات وهو الشيء الذي سيساهم لا محالة في ضمان سيرورة مناخ الاعمال.

Abstract EN

Contractual relations have experienced a significant disorder during the pandemic of Covid-19.

Several contractual obligations couldn't be performed, thus pushing the contracting parties to invoke the force majeure in order to be exonerated from any contractual responsibility.

That said, qualifying covid-19 as force majeure isn't easy, several factors must be taken into consideration, case-by-case treatment is essential, it all depends on the case and its nature.

We consider that it is strongly recommended to include clauses that provides in advance possible solutions of the occurrence of such a case, this will guarantee the legal certainty of the business climate and prevent a potential conflict between parties.
