اتسم القرن 21 بمجموعة من التحولات وعرف طفرة جد مهمة وتقدم ملحوظ في مجال التكنلوجيا والعولمة، مما جعل العالم كله عبارة عن قرية صغيرة يسهل فيها التواصل والحصول على المعلومة، وقد زاد من ذلك حجم المبادلات الاقتصادية والتجارية التي جعلت الحدود الترابية بين الدول تفقد بعضا من دورها الشيء الذي زاد من حجم التهديدات الخارجية التي يتم التخطيط لها من طرف عدة أشخاص أو عبر شبكات داخل بلد معين وتنفذ ببلد آخر، وهو ما يطلق عليه بالجريمة العابرة للحدود او العابرة للقارات.
هذه الظاهرة الجديدة شكلت أولوية ومحط اهتمام لجميع الدول الشيء الذي دفعها إلى التفكير في إيجاد حلول ناجعة للتصدي لها، عبر توحيد قوانينها وتشديد المراقبة على الأشخاص والبضائع والتكتل في اتفاقيات ومعاهدات دولية وإقليمية.
وبحكم موقعه الجغرافي كصلة وصل بين القارة الافريقية وجارتيها الاوربية والامريكية لم يكن المغرب في منئ من هذه التهديدات، وتنفيذا لالتزاماته الدولية، وجد نفسه في أمس الحاجة لسن قوانين جديدة وتشريعات جنائية، حيث انضم إلى اتفاقية باليرم 2000 وادخل تعديلات شتى على القانون الجنائي، ودستور 2011، وهو ما سنتطرق له بالتفصيل في هذا العمل المتواضع.
Abstract EN
The 21st century was marked by a series of transformations, a very important boom and remarkable progress in the technology field and globalization Which made the whole world a small village in which communication and access to information is easy.
This has increased the amount of economic and commercial exchanges, which made the territorial borders between countries lose some of their role.
The thing that increased the amount of external threats that are planned by several people or through networks within a particular country and implemented in another country, which is called transnational or transcontinental crime.
This new phenomenon was a priority and a prim focus for all countries, which prompted them to think of finding effective solutions to address it, by unifying their laws, tightening control over people and goods, and blocking international and regional agreements and treaties.
Because of its geographical location as a link between the African continent and its European and American neighbors, Morocco was not immune to these threats, and in implementation of its international obligations, it found itself in dire need of enacting new laws and criminal legislation, where he joined the Palermo 2000 Convention, and made various amendments to the Criminal Code, and the 2011 Constitution, which we will discuss in detail in this modest work.
