The principle of separation of powers is one of the most important principles of contemporary democracy, in the light of which political systems are adopted and their constitutional rules are defined.

Although the latter requires that each authority exercise its competencies away from the pressure and dominance of any other authority, its flexible application in the Algerian constitutional system led to results that were reflected in the relationship between the legislative and executive authorities, especially the relationship between the President of the Republic and Parliament, on the basis that the authority The legislature has the original competence to enact the law.

The President of the Republic, with exception, shares it in this through the so-called “legislation by order” power, which led to the strengthening of its position in the Algerian political system in accordance with the provisions of Articles 142, 98, 146 of the constitutional amendment 2020.
