الإشاعات من الظواهر الاجتماعية القابلة لقدم البشرية، ولذا حضرت منها الشريعة الإسلامية، لما يترتب عليها من خطورة بالغة على الأفراد والمجتمعات، وإثارة للفتنة بين الناس، وتضليل الرأي العام، ونشر الخوف والقلق بين أفراد المجتمع، بسبب سرعة وسهولة انتشارها، وتأثيرها على الناس، ويزداد خطرها في وقت الأزمات والحروب والثورات، ومن هنا برزت الحاجة إلى ضرورة موقف الشرع منها، والتعرف على الحكم الشرعي لنشر وترويج الإشاعات.
ويهدف البحث إلى توضيح مفهوم الإشاعة، وأنواعها، وبيان الخطر الماتب من الإشاعات على المجتمع، وتفصيل الحكم الشرعي النشر الإشاعات بأنواعها المختلفة، وبيان المواطن التي يجوز فيها شرعا نشر الإشاعات، وأخيرا بيان عقوبة مروجي الإشاعة في الشرح وفي نظام الجرائم المعلوماتية في المملكة العربية السعودية ومن أهم نتائج البحث: أن مفهوم الإشاعة يتمثل في اعتبارها خير أو مجموعة أخبار رائعة تنتشر في المجتمع بشكل سريع وتداول بين العامة صحيحة كانت أو غير صحيحة، من مصدر موثوق فيه أو غير موثوق، وأن ضعف الوازع الديني واستصغار الذنوب في النفوس في هذا الزمن ساعد في كثرة انتشار الإشاعات وترويجها، ولذا جعلت الشريعة الإسلامية الإشاعات من الجرائم المحرمة ديانة والمحرمة قضاء.
Abstract EN
Since the beginning of human kind to date, rumors have been considered a social phenomenon.
Therefore, the Islamic Sharia’a has condemned it for its dangerous consequences on individuals and societies, inciting enmity among people, deceiving public opinion, spreading fear and anxiety due to its fast reach out, and the influence it has on people.
Rumor risks increase during crises, wars, and revolutions.
Hence, there should be a law imposed by Sharia’a that penalizes this prohibited behavior.
This research aims to clarify the concept of rumors, its types and entailed risks on the society.
It also elaborates a breakdown of the law condemning its different types, and identifies the messages that are encouraged to be transmit.
Finally, the rumormongering penalty in both Sharia’a and the cybersecurity system in the Kingdom of Saudi Arabia.
Key outcomes: Rumors are fake news that spread rapidly in the society.
Moreover, lack of piety and undervaluing sins encourage spreading and promoting them.
Thus, Sharia’a has considered it a prohibited illegal crime.
