The death event is the only reason for the transfer of the deceased’s assets from movables, real estate, or real estate rights to the heirs and/or legatees.

however, in order for these properties to be transferred, some conditions must be met that the Algerian legislator approved in the real estate registration laws, the most important of which is that the notarial certificate be prepared that it is the practical tool for establishing what is called the right of inheritance whenever it comes to real estate properties left by the deceased.

this means that these inherited properties cannot be transferred to the heirs and/or legatees legally, and they cannot dispose of them except by issuing and publishing the notarial certificate by the notary at the request of the right holders within specific legal deadlines.

requiring it by the legislator is due to because of its importance, it is a means of maintaining the chain of transfer of real estate ownership, and it also helps in transferring real estate ownership quickly and at the lowest costs.
