على إثر هجمات 11 سبتمبر، بان للولايات المتحدة الأمريكية أنها صاحبة حق في الدفاع الشرعي، بناءا على المادة 51 من الميثاق رغم أن تلك الهجمات لا تنطبق عليها شروط العدوان، كما أن التدابير العسكرية المتخذة من طرف الو م أ لم تكن متماشية ومقتضيات فعل الدفاع كما رسمتها المادة 51، غير أن الو.م.أ أضفت المشروعية الدولية على تدخلها العسكري ضد أفغانستان وكرست حق الدفاع الشرعي ضد الإرهاب الدولي باستصدار القرارين 1368، 1373 (2001) من المجلس.
Abstract EN
Following the events of September 11, the USA has a right to legitimate defense, based on article 51 of the charter, although such attacks do not meet the conditions of aggression, and the military measures taken by the PLO were not in line with the requirements of the act of defense as defined in article 51, but the PLO gave international legitimacy to its military intervention against Afghanistan and enshrined the right of legitimate defense against international terrorism by issuing resolutions 1368 and 1373 (2001) of the council.
