Abstract EN

The application of the principle of free management cannot be effective if the local authority structures in Tunisia are subject to strict supervisory control, as such oversight necessarily reduces the freedom of local authorities in managing their affairs.

Consequently, all forms of supervision, whether exercised by a supervisory authority or among the local authority structures themselves, are incompatible with the fundamentals of this principle.

Therefore, this form of supervision should be abolished, and informal supervision should be strengthened instead.

Adopting the principle of free management for local communities provides a genuine guarantee of their autonomy and represents a serious step towards a decentralized organization where decision-making power lies with local authority structures.

This study relied on the descriptive-analytical method, The findings of this research indicate that the supervisory system for local communities in Tunisia requires an integrated strategy encompassing legislative and regulatory aspects, with a primary focus on improving the human element through education, training, and moral development, both at the level of elected officials and employees of the territorial communities under supervision, and at the level of the human resources exercising that supervision.
