Abstract EN

In view of the great importance of forensic evidence and its instrumental role in revealing the truth by evaluating and scrutinizing such evidence prior the proceedings are brought before competent court, and in order for the case to be based on facts with solid and strong foundations that would identify the perpetrator of the crime or deny the accusatant against the accused, and because the stage of collecting evidence is one of the most important criminal proceedings, therefore, we find that the statute of the international criminal has set the conditions for this stage in line with the seriousness of the international crime.

in consideration of this importance, the statute of the court assigns this task to the general prosecutor, as required by the criminal justice act, which would give the accused every means, even the accused is informed of the nature of the charge against him and of the evidence supporting commission of the cat.

such measures must be carried out in accordance with the guarantees of human rights and fundamental freedoms, which require every a person accused of a criminal case, being aware of it and being exposed to all evidence and information so he can defend himself, which is called the forensic evidence disclosure rule, which was introduced by the international judicial system.
