Abstract EN

This is an analytic study of the terms (Intiqād, Mutāmamah and Ghiar) that are usually used by Ibādῑ jurists to describe the sale contract when it is affected by an ignorance of one of the involved parties.

the study tries to distinguish the difference between Gharar and ignorance in Ibādῑ jurisprudence; and how each of Gharar and ignorance can affect the sale contract.

there is also a comparison between the rulings of affected sale contract by ignorance in Ibādῑ jurisprudence and Hanafῑ jurisprudence.

this study is a preface of further studies in the theory of contract in Ibādῑ jurisprudence.
