Arabic Abstract
جاءت هذه الرسالة لتوضيح مفهوم تغير الأهلية، وبيان أحكامها في مسائل الأحوال الشخصية في الفقه الإسلامي، مقارنة مع قانون الأحوال الشخصية الأردني، وبيان الحالات التي يطرأ عليها تغير الأهلية، وأثرها على الأشخاص الذين يطرأ عليهم التغير.
وجاءت هذه الرسالة للإجابة عن السؤال الرئيس، وهو ما أثر تغير الأهلية على مسائل الأحوال الشخصية، وتوصلت الرسالة إلى نتائج، كان من أهمها: أن التغير بالأهلية أثر واضح على كثير من مسائل الأحوال الشخصية بالجنون والسفه والموت والفقد.
وقد اتبع الباحث في دراسته المنهج الاستقرائي بتتبع أقوال الفقهاء في موضوع هذه الرسالة، والمنهج المقارن ببيان آراء المذاهب الفقهية الأربعة في المسائل التي تناولتها الرسالة، ومقارنتها مع قانون الأحوال الشخصية الأردني، والمنهج الاستنباطي؛ من خلال استنباط تغير الأهلية من كتب الفقه ونصوص قانون الأحوال الشخصية المتعلقة بموضوع الرسالة.
وأوصت الدراسة بضرورة عمل المزيد من الدورات التدريبية لمن لهم علاقة بالقضاء الشرعي؛ للوقوف على آثار تغير الأهلية على مسائل الأحوال الشخصية.
English Abstract
This thesis aims to clarify the concept of changes in legal capacity and delineate its implications in matters of personal status within Islamic jurisprudence, comparing it with the Jordanian Personal Status Law of 2019.
The research also highlights cases where changes in legal capacity occur and their impact on individuals undergoing such changes.
The primary question addressed in this thesis is the effect of changes in legal capacity on personal status issues.
The study yielded significant results, emphasizing that changes in legal capacity have a clear impact on various personal status matters, including insanity, incompetence, death, and loss.
The researcher adopted an inductive approach by examining the opinions of jurists on the subject matter.
A comparative methodology was employed to elucidate the perspectives of the four jurisprudential schools on the issues covered in the thesis, comparing them with the Jordanian Personal Status Law.
Additionally, a deductive approach was utilized to derive insights into changes in legal capacity from both Islamic jurisprudential texts and relevant sections of the Jordanian Personal Status Law.
The study recommends the necessity of conducting more training sessions for those involved in Islamic legal proceedings to comprehend the effects of changes in legal capacity on personal status issues
