Arabic Abstract

هدفت هذه الدراسة إلى جمع واستخراج ودراسة اختيارات ابن أبي موسى في مسائل النكاح والطلاق، ومن ثم دراسة هذه المسائل ومقارنتها.

ولتحقيق أهداف الدراسة قام الباحث باستخدام المنهج الاستقرائي الاستنباطي وذلك من أجل استقراء النصوص والتوصل لاختيارات ابن أبي موسى رحمه الله في المسائل المختارة، ومن ثم استخدام المنهج المقارن لبيان اختيارات ابن أبي موسى رحمه الله ومقارنتها مع أقوال الفقهاء في المسألة والتوصل للرأي الراجع حسب الدليل.

وتوصلت الدراسة لبعض النتائج، من أهمها: إن الإمام ابن أبي موسى-رحمه الله-كان يوافق الحنابلة في بعض المسائل، غير أنه خالف في بعضها مثل: أن حكم النكاح واجب على الإطلاق حيث وافق الظاهرية، وأن ولاية النكاح للأب ثم الابن حيث وافق محمد بن الحسن الشيباني من الحنفية والطحاوي ورواية عن مالك، وأنه لا يصح أن يكون الذمي وليا للذمية في نكاحها من المسلم حيث وافق الحليمي من الشافعية والقاضي من الحنابلة، وإنه إذا زوج اثنان ولم يعلم السابق بطل النكاحان حيث وافق الحنفية والشافعية، وأنه لا يصح أن يتولى العقد في طرفي النكاح من قبل الولي ليزوجها من نفسه حيث وافق الشافعية وزفر من المالكية، وأن الطلاق من الصبي العاقل المميز لا يصح حيث وافق الجمهور في ذلك.

English Abstract

This study aimed to collect, explore, and study the choices of Ibn Abi Musa in issues of Nikah and divorce, and then study and compare these issues.

To achieve the study's objectives, the researcher employed the inductive interpretive methodology, in order to extrapolate the texts and reach the choices of Ibn Abi Musa, may Allah have mercy upon him, and then use the comparative approach to elucidate his choices, compare them with the opinions of jurists on this matter, and ultimately reaching a conclusive opinion based on evidence.

The study reached several results, among the most significant is that Imam Ibn Abi Musa generally aligned with the Hanbalis in some issues.

However, he diverged in others, such as the ruling that Nikah is obligatory in all circumstances, where he agreed with the Zahiri school.

Additionally, he asserted that the guardianship for Nikah belongs first to the father and then to the son, where he agreed with Muhammad bin Al-Hasan Al-Shaybani from the Hanafis, Hanbalis, and a narration from Malik.

He also agreed that a non-Muslim man cannot be the guardian of a non-Muslim woman in marriage of a Muslim man, as agreed upon by Al-Halimi of the Shafi'i school and the judge from the Hanbali school.

In addition, if two individuals are married, and the first party is unaware, the second marriage is considered invalid, where he agreed with the Hanafi and Shafi'i schools.

It is alsoinvalid for the guardian to officiate the marriage contract on behalf of both parties in matrimony with the intention of marrying the woman to himself, aligned with the Shafi'i school and Zafar of the Maliki school.

Furthermore, divorce from a mentally competent and discerning young man is not valid, where he agreed with the consensus of the majority.
