Arabic Abstract

تناولت الدراسة موضوعا من مواضيع الفقه المقارن بقانون الأحوال الشخصية وهو أحكام الصغر والجنون في قانون الأحوال الشخصية الاردني رقم (15) لعام 2019 "دراسة فقهية مقارنة"، وقد هدفت الدراسة إلى بيان هذه الأحكام، وبيان مفهوم الصغر والجنون، وبيان الجانب التطبيقي الذي يظهر من خلاله أحكام تصرفات الصغير والمجنون، وبيان رأي المذاهب الفقهية بها مقارنة مع قانون الأحوال الشخصية بشكل تفصيلي دقيق يشمل أغلب حالات التصرفات، ويوضح للعاملين في سلك القضاء الشرعي من قضاة ومحامين كيفية تعامل قانون الأحوال الشخصية مع حماية تصرفات الصغير والمجنون، واتبعت الدراسة المنهج الوصفي والاستقرائي والمقارن.

وخلصت الدراسة إلى عدد من النتائج أهمها: أولى الإسلام اهتماما بالغا بالرعاية الوقائية للصغار وتربيتهم، حيث أوجب لهم حقوقا حتى قبل ولادتهم باختيار الزوجة الصالحة التي ستكون أما صالحة للصغير، ومن حقه اختيار الاسم الحسن والحضانة والنفقة والتعليم، ورعايته وغرس القيم النبيلة فيه، وتنشئته على فضائل الإسلام والعقيدة الصحيحة وغرس الأخلاق الفاضلة وتحذيره من الانحراف سواء على مستوى الأسرة أو المدرسة أو وسائل الإعلام، وأوصت الدراسة بضرورة المزيد من البحث والدراسة الفقهية والمقاصدية في أحكام الصغير والمجنون في العقوبات والمعاملات المالية وأن يتعمقوا في هذا الموضوع بشكل دقيق، فلا تزال كثير من أحكامه تحتاج إلى جمع، وتدقيق.

English Abstract

The study dealt with one of the topics of comparative jurisprudence with the Personal Status Law, which is the provisions of minors and insanity in jurisprudence and the Jordanian Personal Status Law No.

(15) of 2019 and its applications in the Jordanian Sharia courts, “a comparative jurisprudential study.” The study aimed to clarify these provisions and explain the concept of minors and insanity.

And an explanation of the practical aspect through which the provisions on the actions of the minor and the insane appear, and a statement of the opinion of the jurisprudential schools regarding them compared to the Personal Status Law in a detailed and accurate manner that includes most cases of behavior.

It explains to those working in the Sharia judiciary, including judges and lawyers, how the Personal Status Law deals with protecting the actions of the minor and the insane.

The study followed the descriptive, inductive and comparative method The study concluded with a number of results, the most important of which are: Islam gave great attention to the preventive care and upbringing of children, as it imposed on them rights even before their birth to choose a good wife who will be a good mother for the child, and he has the right to choose a good name, custody, maintenance, and education, to care for him, instill noble values in him, and raise him.

On the virtues of Islam and the correct belief, instilling virtuous morals, and warning against deviation, whether at the level of the family, school, or the media.

The study recommended the necessity of further research and jurisprudential and purposeful study of the rulings on the minor and the insane in punishments and financial transactions, and to delve into this subject in a precise manner, as many of its rulings are still in effect.
