The auction sale adjudication in the Algerian legislation can’t be considered as a judgement in the strict sense of the term; judgement, because it can neither adjudicate a litigation nor resolve a dispute; even it is issued in the form of a judicial decision.

also, the Algerian legislator considered the auction sale judgement as a judicial sale contract it means a compulsory sale proceeded by a procedural act which is established by law.

though this sale is promulgated as a judicial decision, it is a state-level decision 'order'.

because law can’t be appealed unlike judgments.
