The rules of the public sector employment are divided between the legislative and the regulative fields.

However, while the Parliament is exercising its legislative role, and the government its regulative authority, they may exceed their jurisdiction limits, and in some cases, each one may exercise the other’s jurisdictions.

For instance, the Parliament can legislate in areas not related to the law, and the government can take some decisions that fall within an article of the law.

For this reason, the constitutional judiciary which is in charge of controlling and determining the law and regulations’ areas, including public employment, interferes through adopting a basic mechanism asa criterion for the distribution of jurisdiction.
