Abstract EN

This research dealt with the statement of the extent of the legal responsibility of the engineer and the contractor in ensuring the durability of the building in the comparative Jordanian legislation.

it was found through the research that the Jordanian legislator considered the responsibility of both the contractor and the engineer to be part of the public order so that both the contractor and the engineer are jointly liable in the guarantee.

from the contractor and the architect, it is not negated unless there is a foreign reason such as force majeure, for example.in conclusion, the study recommended that the Jordanian legislator expand the protection circle for this responsibility and introduce guarantees other than the decimal guarantee, and subject everyone who participated in the construction process to the provisions of special responsibility, similar to the French legislator, as well as that the Jordanian legislator increase the guarantee period in large works and mega projects that you need more time to detect defects that may threaten the durability and safety of the construction.
