Abstract EN

This article addresses the issue of the hierarchy of legal rules in light of the jurisprudence of the Moroccan constitutional judiciary and aims to highlight the extent to which the Moroccan legal system respects the principle of hierarchy of laws and the non-overlapping of legal fields.

The analysis concluded that the Moroccan legislator adhered to the principle of gradualism in its various legal systems and did not allow the lower rule to interfere with the higher rule, by respecting this principle in its legal system, and implementing constitutional judicial oversight.
