يهدف هذا لابحث إلى التعريف بزواج المسيار، وبيان طبيعته، و معرفة الأسماء التي عرف بها عند الفقهاء القدماء، و أسباب ظهوره، و انتشاره بين الناس، و استقصاء آراء العلماء في شروطه، و كشف النقاب عن أدلة الذين أجازوه و الذين منعوا .
و تأتي أهمية هذا البحث في مناقشة أدلة المجيزين، و في الرد على أدلة المانعين، و قد توصل الباحث إلى الحكم الشرعي بجواز زواج المشيار بشرط توافر الأركان و الشروط الشرعية، و جواز تنازل المرأة عن بعض حقوقها كالنفقة و العدل في البيتوتة، و من شروط جوازه أن تغلب المصلحة على المفسدة ، فإن غلبت المفسدة على المصلحة في هذا الزواج جاز للإمام منعه من باب السياسة الشرعية كما فعل عمر بن الخطاب – رضي الله عنه – في منع الزواج من الكتابيات .
و قد جاء البحث في أربعة مباحث و خاتمة على النحو الآتي : المبحث الأول : الترعيف الفقهي بزواج المسيار، و تاريخه و أسباب انتشاره .
المبحث الثاني : التكييف الفقهي لزواج المسيار، و أركانه، و شروط عقده .
المبحث الثالث : آراء الفقهاء في زواج المسيار .
المبحث الرابع : أدلة الفقهاء في الزواج المسيار، و الرد عليها .
أما الخاتمة : فتتضمن النتائج التي توصل إليها البحث من خلال التحليل و الدراسة
Abstract EN
This study aims at introducing the nature conditions and the reasons of the emergence of Messyar marriage.
It also aims at pointing out the justifications of those who licensed it and those who prohibited it.
The significance of the study is represented in its attempt in discussing the justifications of those who defend Messyar marriage and those who oppose it.
The main result of this study is that the researcher has arrived at a conclusion that Messyar marriage is lawfull from jurisprudence view provided that all conditions of the marriage are met, from jurisprudence perspective the woman has the right to overlook some of her rights for the god of hers priority is given to the good of this marriage since one of the reasons of making this marriage is stop corruption from spreading.
