منذ أن انطلقت انتفاضة الأقصى المبارك في الثامن و العشرين من أيلول عام 2000 بدأت وسائل الإعلام الاسرائيلية تصف ما ينبثق عن هذه الانتفاضة المباركة من أعمال و فعاليات إرهابية مما دفع بعضا من وسائل ال‘لام الغربية أن تتبنى هذا الاتجاه المضلل و تصف المقاومة الشعبية الفلسطينية بأنها إرهاب .
غير أنه مما لا شك فيه أن هنالك خلطا واسعا بين الإرهاب و أعمال الكفاح المسلح التي تقوم بها الشعوب الخاضعة لاحتلال أجنبي وصولا إلى حقها في تقرير المصير .
و تهدف هذه الدراسة إلى أن تضع الأمور في إطارها القانوني الصحيح، و بيان أن الإرهاب في القانون الدولي ليس من أعمال الأفراد و الجماعات فقط، و إنما قد تمارسه الدول بصوره المختلفة ضد الأفراد و الجماعات بصورة أكبر و أشد عنفا، وتبين الدراسة أيضا بأنه يخرج من إطار الأعمال الإرهابية، التي يقوم بها الشعب المحتل ضد محتليه، كما تبين أن كثيرا من الأفعال التي ارتكبت من قبل إسرائيل خلال انتفاضة الأقصى، ينطبق عليها وصف جريمة إبادة الجنس البشري، و قد جاء هذا البحث في أربعة مباحث و خاتمة .
المبحث الأول : التعريف بالإرهاب في القانون الدولي .
المبحث الثاني : أنواع الإرهاب .
المبحث الثالث : التفرقة بين الإرهاب و المقاومة الشعبية المسلحة .
المبحث الرابع : الأعمال الإرهابية الإسرائيلية التي ترتكب بحق الشعب الفلسطيني .
الخاتمة و التوصيات : و اشتملت على أهم النتائج و التصيات التي توصل إليها هذا البحث .
Abstract EN
Since the beginning of the Al-Aqsa Intifada on the 28th of September 2000, the Israeli media has categorized the activities of the uprising as acts of terror.
Consequently, some western media adopted this misleading stance and portrayed the Palestinian popular resistance as terrorism.
No doubt, conceptual jumbling has become widespread between a people’s armed struggle against foreign occupation to achieve self determination and terrorism.
The study aims at placing these matters in their proper legal framework.
It shows that under international law, terrorism is not limited to acts by individuals or groups.
States practice terrorism in its various forms against individuals and groups; these actions are more comprehensive and more violent.
The study also shows that actions by people under occupation against the occupier do not fall under the definition of terrorism in international law.
Furthermore, many actions by the state of Israel during the Al-Aqsa uprising against the Palestinians fall under genocide.
The research is comprised of four sections and a conclusion.
The first section discusses the definition of terrorism under international law.
The second describes the various forms of terrorism.
The third distinguishes between terrorism and popular armed resistance.
The fourth examines the extent to which Israeli actions against the Palestinian people during the Al-Aqsa uprising constitute genocide.
The conclusion section presents the outcomes of the study.
