بموجب المادة 90 من القانون المدني الأردني رقم 43 لسنة 1976 فإن العقد ينعقد بمجرد لارتباط الإيجاب بالقبول مع مراعاة ما يقرره القانون فوق ذلك من أوضاع معينة لانعقاد العقد.
و قد بينت المادة 91 من القانون ذاته المقصود بالإيجاب و القبول بقولها : إن الإيجاب و القول هما لفظين مستعملين عرفا لإنشاء العقد, و أن أي لفظ يصدر أولا فه إيجاب و أن أي لفظ يصدر لاحقا فهو قبول.
القانون الإنجليزي, من ناحية أخرى, لم يضع تعريفا محددا للعقد, و لكن الفقهاء الإنجليز عرفوا العقد على أنه اتفاق يلزم أطرفاه و يتم بالإيجاب و القبول.
هذا البحث ناقش كيفية التعبير عن لإرادة في التعاقد في القانون المدني الأردني و القانون الإنجليزي و قد خص إلى أن هناك عدة نقاط يلتقي فيه القانون معا و عدة نقاط يختلفان فيها عن بعض.
Abstract EN
By virtue of section 90 of the Jordanian Civil Code No.43 of 1976, a contract is made as soon as an offer coincides with an acceptance, subject to any additional conditions which the law may prescribe.
Section 91 of the Code indicates that offer and acceptance are two conventional used in such expressions contracts.
The former expression is the offer and the latter is the acceptance.
English law, on the other hand, has not specifically defined a contract, but English jurists have defined a contract as an agreement which arises from an offer and an acceptance and which binds the parties.
This paper has discussed how the will is expressed and communicated in contracting under the Jordanian Civil Code as well as in the English law.
It reached the conclusion that here are many similasites and differences between the two laws.
