الطلاق و إن كان حقا للزوج يستعمله متى شاء و بإرادته المنفردة إلا أنه لا يتم إلا بوساطة القضاء معطيا بذلك الحق للزوجة ليتم تدقيق الخلاف الذي و قع بينهما قبل إصدار الحكم بإيقاع الطلاق أو التفريق، هذا فضلا عن بذل مساعيه من أجل إحقاق الحق لكل من الزوجين، فمتى أساء أحدهم استعماله وجب عليه التعويض.
