English Abstract

Why the Jordanian environmental situation does not reflect the legal protection of the right to a healthy and safe environment? Answering this question is the main objective of the research, meanwhile other objectives are considered such as evaluating the effectiveness of the Jordanian environmental legislation and the legal application in protecting this right, the judicial awareness of the environmental legislation and the importance of protecting the environment, and the public awareness to this right.

The methodology has included in-depth literature, internet and media review, review of Court of Cassation decisions for environmental cases, on-site interviews with governmental and nongovernmental parties, and questionnaires to representative samples of judges and the public in Al-Hashimyeh, as Al-Hashimyeh is known to be a key environmental hot spot in Jordan.

Though Jordan has environmental legislation, it falls short from the required protection that the environment is in need for.

The lack of effective and comprehensive national legislation is a major barrier.

Each of the studied players; Executive, Legislative and Judicial authorities, Non- Governmental Organizations (NGOs) and media has defects in performing the issues related to the right to a healthy and safe environment.

These defects are not only because of lacking the required technical and financial infrastructures, but also because of the lack of well prepared and known criteria and mechanisms as well as communication and coordination.

Among any other recommendations, the most important recommendation is having the necessary support to strengthen and ensure effectiveness of the environmental legislative frame, finding effective mechanisms to deal with all difficulties in most effective and cooperative way, stating the right to a healthy and safe environment in the constitution of Jordan as well as raising the awareness on sustainable development at all levels.
