Abstract EN

The present study is concerned with evaluating a book which became famous in the fifth Hijra Century.

The book is Al Ahkam Al Sultaniya (The rules of caliphate) by the judge Abi al -Hasan Al Mawardi.

A considerable amount of controversy has been found around the book concerning its topic and methodology scored by those of his own generating and contemporary writers.

The present research aims at pursuing the criticisms directed to the book through ages and analyzing them to find out the historical conditions that govern the critieizers starting from the scholars of his generation during the seljuuqi and mamluki eras.

The researcher accounted for the reactions of the scholars during Othmani era, then a discussion of the reformers (Arabs and Oriantalists) who have various attitudes towards the book which are reflected in their writings.

The objective reasons that underlie their criticisms and the role of judicial and intellectual schools which this or that writer represents.

Most of these writers, in fact, were only concerned with the approach or style of the book and deliberate choice of specific chapters without acknowledging him or making cross reference to his book.

The research is restricted to investigate the criticism directed to Al Mawardi and his book Al Ahkam Al Sultaniya leaving a side those who praised him and acknowledged him in their writings.
