Abstract EN

This study examines the relationship between the contract of supply and the contract of financing lease under the Jordanian law of financing lease.

The study clarifies how the Jordanian legislator takes this relationship as a ground to regulate the formation of the contract of financing lease and to determine the legal consequences of such contract.

This study explores the right of the lessee to recourse against the supplier where the latter breach his obligations under the contract of supply.

In doing so, it points out that the right to recourse against the supplier includes the right of rescission which has not been recognized by the previous Jordanian law and by some Arab and foreign legislations.

On the other hand, the study explains the legal consequences of dissoluting the contract of supply (by rescission or nullification) and its effect on the contract of financing lease, an issue not addressed by the Jordanian law of financing lease.
