Abstract EN

Right to personal photograph has assumed paramount importance in the recent years.

Multiple developments _____ spread of imaging devices; mobile phones equipped with cameras; and computers _____ have contributed significantly towards importance for the legal security of right to personal photograph.

With the advent of above-cited developments, it has become possible to both send and receive images in seconds to millions through PC’s connected with internet.

The end result is obvious.

Right to personal privacy is in jeopardy.

This new threat has prompted many world states to consider ways and means of restoring the right to private privacy associated with exposure of personal photo images.

In order to ensure needed protection, in-depth studies are under way to make new legislations.

Some countries have made concerted start on the project.

The present study has focused on the relative contribution rendered by Kuwait.

It has expounded that Kuwait has made scientific-oriented endeavours to grant adequate protection.

The protection is covered in Kuwaiti civil law.

The present study, in incorporating its presentation, has employed a descriptive-comparative approach.

Pursuant to this approach, it has compared with pertinent Egyptian judicial applications.

The study, as a whole, is divided into three sections.

First section identifies the right to personal photograph and the relative Kuwaiti standpoint.

Second section uncovers the legality of right to personal photograph and its distinctive characteristics.

Third section sheds light on its protection in civil law.

The study, in its conclusive pages, provides salient findings.

Among the latter, the following stand outstanding: • Photo image right is one of the rights associated with human personality.

Its violation means the violation of the right to privacy.

• Photo image right needs protection under civil law.
